2.Interpretation

(1)In this Code, unless the context otherwise requires —

“advocate” means an advocate and solicitor lawfully entitled to practise criminal law in Singapore;

“arrestable offence” and “arrestable case” mean, respectively, an offence for which and a case in which a police officer may ordinarily arrest without warrant according to the third column of the First Schedule or under any other written law;

“bailable“audiovisual offence”recording” means an offence shown asaggregate bailableof invisual theimages fifthand columnsounds ofembodied thein Firsta Schedulething, orso whichas isto madebe bailablecapable, by anythe otheruse writtenof law,that andthing, “non-bailableof offence”being meansproduced anyelectronically offenceand othershown thanas a bailablemoving offence;picture with associated sounds;

“complaint”“bailable offence” means anyan allegationoffence madeshown orallyas orbailable in writing tothe afifth Magistratecolumn withof athe viewFirst toSchedule hisor takingwhich actionis undermade thisbailable Codeby thatany someother person,written whetherlaw, knownand or“non-bailable unknown,offence” hasmeans committedany oroffence isother guiltythan ofa anbailable offence;

“computer”“child hasabuse theoffence” samemeans meaningan asoffence inunder section 5(1), 6,6(1), 7, 11(2),8, 1214(2), 16 or 1317 of the ComputerChildren Misuse and Cybersecurityand Young Persons Act (Cap. 50A);38),1993, or an offence under section 377BG, 377BH, 377BI, 377BJ, 377BK or 377BL of the Penal Code (Cap. 224),1871, and includes an abetment of, a conspiracy to commit, or an attempt to commit, such an offence;

“court”“complaint” means theany Courtallegation ofmade Appeal,orally theor Highin Court,writing to a FamilyMagistrate Court,with a Youthview Court,to ahisthe Magistrate Districttaking Courtaction orunder athis Magistrate’sCode Court,that assome theperson, casewhether mayknown be,or whichunknown, exerciseshas criminalcommitted jurisdiction;or is guilty of an offence;

“criminal record” means the record of any —

“fine” means any fine or financial penalty imposed by any court upon any conviction of any offence;

“Criminal Procedure Rules” —

(a)means the Criminal Procedure Rules 2018 made under this Code and any other written law by the Criminal Procedure Rules Committee constituted under section 428A; and

(b)includes any subsidiary legislation deemed under section 428A(15) to be Criminal Procedure Rules;

“Judge” means a Judge of the High Court and includes the Chief Justice and any person appointed to exercise the powers of a Judgesitting in the High Court in accordance with section 9 of the Supreme Court of Judicature Act (Cap. 322);

“criminal record” means the record of any —

“writing” includes any mode of representing or reproducing words, figures, drawings or symbols in a visible form, whether permanent or otherwise.

(1A)Any power conferred on a court by this Code to make an order for the disposal of any property includes a power to make an order for the forfeiture, confiscation or destruction of the property, or for the delivery of the property to any person, but must be exercised subject to any provisions on forfeiture, confiscation, destruction or delivery in any other written law that is applicable to the case.

(2)Words and expressions used in this Code which are defined in the Penal Code 1871 but not defined in this section shall have the same meanings given to them by the Penal Code.Code 1871.
